Please read these Terms and Conditions (“Terms”) carefully before purchasing from BTHMusic. By purchasing any digital product from this website, you agree to be bound by these Terms.

2. Products & Pricing
2.1 All products are digital sheet music sold in PDF format only.
2.2 All prices are listed in Australian Dollars (AUD).
2.3 Prices are subject to change at any time without notice.
2.4 No physical items will be shipped.
3. Payment
3.1 Payments are processed securely via Stripe using credit or debit card.
3.2 By completing a purchase, you confirm that you are authorised to use the selected payment method.
3.3 BTHMusic does not store any payment details.
4. Delivery & Downloads
4.1 All purchases are delivered via instant digital download upon successful payment.
4.2 Each purchase includes up to two (2) download attempts.
4.3 It is the purchaser’s responsibility to download and securely store their files.
4.4 If access to your files is lost, you may contact [email protected] for assistance. Reasonable efforts will be made to restore access.
5. Licence & Permitted Use
5.1 Upon purchase, you are granted a non-exclusive, non-transferable, lifetime licence to use the purchased work.
5.2 This licence is granted to the individual purchaser only.
5.3 The purchaser may:
- Use the work with any ensemble they are involved with, now or in the future
- Print copies for use within those ensembles
- Store copies for personal and ensemble use
5.4 This licence does not transfer to any organisation, band, or third party.
6. Restrictions & Copyright
6.1 All works remain the copyright of Benjamin Tubb-Hearne.
6.2 The purchaser must not:
- Share, distribute, or forward digital files to any other person or organisation
- Upload files to shared drives, public platforms, or file-sharing services
- Provide copies to ensembles not directly associated with the purchaser
- Sell, sublicense, or otherwise redistribute the work in any form
6.3 The purchaser agrees to take reasonable steps to prevent unauthorised copying or distribution.
6.4 Arrangements, adaptations, or modifications of any work are strictly prohibited without prior written permission.
7. Performance & Recording
7.1 Purchased works may be performed publicly without additional permission.
7.2 Audio and video recordings of performances may be shared online, including on social media platforms.
7.3 All performances and recordings must include the credit:
“Music by Benjamin Tubb-Hearne”
8. Refunds & Australian Consumer Law
8.1 Due to the digital nature of the products, refunds are not provided for change of mind.
8.2 However, nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL).
8.3 If a product is faulty, corrupted, or not as described, please contact [email protected] to resolve the issue.
9. Technical Limitations & Support
9.1 BTHMusic does not guarantee that files will be compatible with all devices, software, or systems.
9.2 BTHMusic is not liable for issues arising from:
- User software or hardware limitations
- Internet or download interruptions
- Incorrect use or handling of files
9.3 If you experience any issues, please contact [email protected], and reasonable efforts will be made to assist and provide a working file.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, BTHMusic is not liable for any indirect, incidental, or consequential loss arising from the use of its products.
10.2 Where liability cannot be excluded under Australian law, it is limited to the replacement of the product or resupply of the service.
11. Privacy
11.1 BTHMusic collects customer information (such as name and email address) solely for:
- Processing purchases
- Record-keeping
- Customer support
11.2 Customer information will not be sold, shared, or distributed to third parties, except where required by law.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of Queensland.
